Terms of Use

1. Agreement to these terms

These Terms of Use ("Terms") are a legal agreement between you and Johnny Pack, an independent developer based in Tennessee, United States ("I", "me", "the developer"), covering the Reel Rush Fishing mobile application (the "App") and this website.

By downloading, installing or using the App, you accept these Terms. If you do not accept them, do not use the App and delete it from your device. If you are under the age of majority where you live, you may only use the App with the involvement of a parent or guardian who accepts these Terms on your behalf.

These Terms are in addition to Apple's own Apple Media Services Terms and Conditions, which govern your use of the App Store.

2. Licence

The App is licensed to you, not sold. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable licence to download and use one copy of the App for your own personal, non-commercial entertainment, on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

This licence does not transfer any ownership. All rights not expressly granted here are reserved.

3. What you may not do

You agree not to:

• copy, redistribute, sell, rent, lease, sublicense or lend the App;
• reverse engineer, decompile or disassemble the App, or attempt to derive its source code, except to the extent that applicable law expressly permits it despite this restriction;
• modify or create derivative works of the App, or remove any copyright or proprietary notices;
• use cheats, memory editors, automation, modified clients or exploits to alter game state, gain in-game currency or items you did not earn or pay for, or manipulate leaderboard scores;
• attempt to obtain in-app purchase items without paying for them, including by tampering with purchase verification;
• use the App for any unlawful purpose, or in breach of any applicable law or regulation.

The App keeps no accounts and has no way to ban anyone, but leaderboard scores that are obviously manufactured may be reported to Apple for removal from Game Center.

4. In-app purchases

The App is free to download and free to complete. It offers optional in-app purchases: consumable top-ups of in-game currency, a one-time starter bundle, and three non-consumable premium boats.

• All purchases are processed by Apple through the App Store. The price shown in the App in your own currency at the moment of purchase is the price you pay, and it is charged to your Apple Account.
• Prices vary by country and may change. A purchase is complete when Apple confirms it; the item is then credited in the game.
• Consumables (currency packs, starter bundle) are spent in the game, are used up when you spend them, and are not restorable. They are tied to the device save they were credited to.
• Non-consumables (premium boats) are permanently associated with your Apple Account and can be restored at no cost using Restore Purchases in the Cash Shop, on any device signed in to that account.
• You are responsible for purchases made on your device, including by children. Apple's Screen Time restrictions and Ask to Buy can prevent them — see the FAQ.

5. Virtual currency and items

In-game cash, bait, tackle, boats, upgrades, trophies and every other in-game item are virtual items. They are a licensed feature of the App, not your property. Specifically:

• they have no monetary value and cannot be exchanged for real money, goods or anything of value outside the App;
• they cannot be transferred, sold, traded or gifted between players, accounts or devices;
• they exist only inside the App and only for as long as you retain your game data — deleting the App, resetting progress or losing an unbacked-up device ends them;
• the amount of currency an item grants, and what things cost in game, may be re-balanced in future updates;
• nothing in the App is a game of chance, a wager or a lottery. The in-game Fishing Derby is a skill contest with an in-game entry fee and an in-game prize, and there is no way to convert any of it into anything of real value.

6. Refunds

Because Apple is the merchant of record for every purchase, Apple handles all refunds. Request one at reportaproblem.apple.com using the Apple Account that made the purchase. The developer cannot issue, guarantee or override an App Store refund decision.

If Apple refunds or revokes a non-consumable purchase, the corresponding item is removed from the game the next time it checks entitlements. Nothing here affects statutory consumer rights you may have where you live, including any right of withdrawal.

7. Availability, updates and changes

The App is provided on an "as available" basis. I may update it, change its features, re-balance its economy, add or remove content and in-app purchase items, raise the minimum iOS version, or stop distributing or supporting it entirely, at any time and without notice or liability.

Because the App stores your progress on your own device, discontinuation would not delete anything you already have — but no promise is made that any particular feature, water, species or item will remain available forever.

8. Apple, Game Center and other services

Optional leaderboards are provided by Apple's Game Center and are subject to Apple's terms and privacy policy. Signing in is entirely your choice and the App works fully without it. Apple may change, interrupt or discontinue Game Center at any time; the developer has no control over that and no liability for it.

You agree to comply with any applicable third-party terms — for example the Apple Media Services Terms and Conditions and your mobile data plan — when you use the App.

9. Intellectual property

The App and everything in it — its code, artwork, fish and tackle designs, sounds, text, name, icon and overall look and feel — is owned by Johnny Pack and protected by copyright and other intellectual property laws. "Reel Rush" and "Reel Rush Fishing" are used as the game's marks.

Screenshots and video you capture of your own play are yours to post, stream and monetise, on any platform, without asking. That permission covers gameplay content only; it does not permit redistributing the App itself, extracting or reusing its art or sound assets, or presenting the game as your own product.

Apple, iPhone, iPad, iOS, App Store and Game Center are trademarks of Apple Inc. Real place names used for in-game waters are referenced descriptively; no affiliation with or endorsement by any government, agency, business or organisation associated with those places is claimed or implied.

10. Your feedback and suggestions

Suggestions are genuinely welcome. If you send an idea — a species, a water, a feature, a bug report — you grant permission to use it in the App without obligation, compensation, confidentiality or credit. This is not an attempt to take anything from you; it simply avoids a situation where a feature that was already planned, or that two people suggest independently, creates a dispute. You keep any rights you hold in your idea and remain free to use it yourself.

11. Disclaimer of warranties

To the maximum extent permitted by law, the App and this website are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment or non-infringement.

No warranty is given that the App will be uninterrupted, error-free, free of harmful components, compatible with every device or iOS version, or that any defect will be corrected. You install and use it at your own discretion and risk, and you are responsible for backing up your device.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits any non-waivable statutory consumer rights.

12. Limitation of liability

To the maximum extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, game progress, virtual items or goodwill, arising out of or relating to the App or these Terms — whether based on contract, tort, negligence, strict liability or any other theory, and even if advised of the possibility of such damages.

In any event, the developer's total aggregate liability arising out of or relating to the App will not exceed the greater of (a) the total amount you actually paid for in-app purchases in the twelve months before the claim arose, or (b) US $50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

13. Indemnity

You agree to indemnify and hold harmless the developer from any claim, demand, loss or expense (including reasonable legal fees) arising out of your misuse of the App, your breach of these Terms, or your violation of any law or of another person's rights.

14. Termination

This licence continues until terminated. It ends automatically if you breach these Terms, and you may end it at any time by deleting the App from your devices. On termination you must stop using the App; sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, indemnity and governing law — survive.

15. Required App Store terms

Apple requires the following to be stated in any licence agreement for an app distributed through the App Store. Where anything above conflicts with this section for App Store distribution, this section controls.

1. Acknowledgement. These Terms are between you and Johnny Pack only, not with Apple. Apple is not responsible for the App or its content.
2. Scope of licence. The licence granted is non-transferable and limited to use of the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
3. Maintenance and support. Johnny Pack is solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support services.
4. Warranty. Johnny Pack is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
5. Product claims. Johnny Pack, not Apple, is responsible for addressing any claims relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
6. Intellectual property rights. In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, Johnny Pack, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer name and address. Questions, complaints and claims about the App should be directed to Johnny Pack at johnnycpack@gmail.com. A postal address is available on request.
9. Third-party terms. You must comply with applicable third-party terms of agreement when using the App.
10. Third-party beneficiary. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of them Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

16. Governing law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. You and the developer agree to the exclusive jurisdiction of the state and federal courts located in Tennessee for any dispute arising out of or relating to these Terms or the App.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings locally and to the protection of mandatory consumer rules, nothing here deprives you of that right or of those protections.

17. General

• Changes. These Terms may be updated. The date at the top will change, and continuing to use the App after an update means you accept the revised Terms. If you do not, delete the App.
• Severability. If any provision is held unenforceable, the rest remains in force and the unenforceable part is applied to the maximum extent permitted.
• No waiver. A failure to enforce any provision is not a waiver of it.
• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and the developer about the App, and replace anything said or written earlier about it.
• Assignment. You may not assign these Terms. The developer may assign them in connection with a transfer of the App.
• Language. These Terms are written in English. A translation, if provided, is for convenience only, and the English version governs.
